I. SCOPE OF APPLICATION

  1. The business relationship between ConFusion - Mag. Clemens Drdla, hereinafter referred to as ConFusion, and persons and companies ordering services or products from ConFusion, hereinafter referred to as the customer, is governed exclusively by the General Terms and Conditions set out here in the version valid at the time of the order.

  2. The following conditions apply to all deliveries and services provided by ConFusion or a subcontractor named by ConFusion within the scope of this contract. Deviating or conflicting conditions, amendments or additions to this contract are only effective after express written confirmation by ConFusion.

II COOKING COURSES, seminars, training courses etc.: Booking and cancellation conditions

  1. Registration for a cookery course is binding and is valid for the selected cookery course and the specified date.
  2. The customer's booking is secured with the payment of the course fee or the redemption of a valid voucher number to the corresponding value. Participation in the cookery course is only possible with full payment of the course fee.
  3. ConFusion reserves the right to exclude participants from events if they could endanger other people (e.g. through excessive alcohol consumption, inappropriate behaviour, infectious disease, positive Covid test result, etc.).
  4. The booked seats are transferable to other persons.
  5. The course fee cannot be refunded in the event of cancellation by the customer (also due to illness or a positive Covid test result, etc.). The following conditions apply to cancellations and rebookings.
  6. Rebookings, cancellations and changes: Changes to bookings and cancellations must be made in writing and are only valid after written confirmation.
    • Standard tickets:
      • Up to 14 days before the start of the course, you can change your booking to another course date free of charge. You can choose from the entire ConFusion and Kitchen Skills course programme, provided there are free places available. Alternatively, the course place can also be converted into a voucher. If the price of the newly selected course is higher than the previously selected course, the difference must be paid.
      • Cancellation fees of 50% of the course costs will be charged up to 5 days before the start of the course. The remaining amount can be credited to another course or issued as a voucher.
      • In the last 5 days before the start of the course or if the participant does not show up, cancellation costs amounting to 100% of the course costs will be charged.
    • Cancellation protection tickets (in case of accident or illness): In the event of accidental injury or serious illness, it is possible to rebook a standard ticket for another date of an equivalent event up to the course date for a surcharge of € 10. A medical confirmation of a serious illness or an accident that makes it impossible to attend the event is considered proof. The medical certificate must be issued to the person registered for the course. The cancellation protection ticket must be booked directly when booking online via Bookingkit on our website. When registering by email, the person making the booking must expressly state that a cancellation protection ticket is to be booked. Otherwise the booking is considered a standard ticket. In the event of an accident or serious illness, ConFusion/Kitchen Skill must be informed in writing as soon as possible. Intentional or grossly negligent acts and reasons for cancellation that were already known at the time of booking are expressly excluded.
    • When booking via other booking platforms such as Miomente or Jollydays, only their terms and conditions apply to cancellations or rebookings (e.g. with Miomente, a rebooking is only possible up to 21 days before the start of the course).
    • When booking from Events for closed groups (corporate and private) can be postponed to another date free of charge up to 6 weeks before the event date. Cancellations within 6 weeks of the event date will incur a 50% cancellation fee. Cancellations within 7 days before the event will incur a cancellation fee of 100%. A change in the number of participants is only possible in writing and after approval by ConFusion/Kitchen Skills. A reduction in the number of participants is possible up to 7 days before the event and by up to 20% of the original number of participants. In the event of an increase in the number of participants, the actual number will be charged.
  7. If a cooking course is cancelled by ConFusion/Kitchen Skills, your course fee can be transferred to another course or refunded. If the course fee was paid with a voucher, a new voucher will be issued for the redeemed value.
  8. The cookery courses take place with a minimum of 8 participants. ConFusion/Kitchen Skills reserves the right to cancel or postpone cooking courses due to an insufficient number of participants or for other reasons.
  9. Participation in cookery courses is at your own risk.
  10. Cooking events for closed groups can be booked either in writing or by telephone, but the date and price are only valid after written confirmation or offer. Our individual offers and terms of payment apply.

III. RIGHT OF CANCELLATION

  1. The right of cancellation applies exclusively to consumers and goods from the online shop of www.confusion-kochen.at. The right of cancellation does not apply to the booking of event dates within the next 14 days and of closed events or other events.
  2. Consumers have a 14 or 30-day right of cancellation to withdraw from the contract without giving reasons. The cancellation period for cookery courses and vouchers is 14 days. The cancellation period for goods from the webshop is 30 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods. To exercise the right to cancel, you must inform us (ConFusion - Asiatisch kochen, Mag. Clemens Drdla, Fuchsthallergasse 12, 1090 Wien, E-Mail: info@confusion-kochen.at, (telephone: +43 664 142 53 89) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).
  3. The customer must pack the goods carefully for return, notwithstanding his right of cancellation.
  4. The buyer shall bear the direct costs of the return shipment after cancellation within the scope of return shipments.
  5. The right of cancellation does not apply to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. Likewise, the right of cancellation does not apply to goods that must be stored refrigerated, even if they are still unopened or sealed.

IV. PRICES

  1. All prices are in euros, including statutory VAT (unless otherwise stated) and apply to the services or products described.
  2. Subject to printing errors and price changes.

V. PAYMENT

  1. Unless otherwise agreed, all invoices are due immediately and without deduction.
  2. The following payment methods are possible: advance payment, payment by credit card (Visa/Mastercard), payment by debit card (Maestro), payment by Paypal, payment on account (bank transfer)
  3. In the event that credit institutions or banks refuse payment due to insufficient funds, ConFusion reserves the right to deliver by prepayment or to cancel the order.
  4. The right of the customer to offset against claims of ConFusion is excluded, unless this counterclaim has been established by a court or recognised in writing by ConFusion.
  5. The following applies to companies, group courses, catering or other events: A deposit of 50% must be paid when ordering. The remaining amount is due after fulfilment of the contract.

VI. TERMS OF DELIVERY 

  1. Delivery shall be at the customer's expense and risk.
  2. ConFusion is free to choose the mode of dispatch and transport within the scope of the usual modes and means of transport. Complaints arising from transport damage must be made by the customer immediately upon receipt of the goods to the transport company in writing on the delivery note and notified to ConFusion in writing within 3 days of receipt of the goods. Any costs and measures incurred for the storage of the delivered goods shall be borne by and at the expense of the customer.

VII. RESERVATION OF TITLE 

The delivered goods remain the property of ConFusion until full payment of all claims existing against the customer.

VIII. WARRANTY

  1. Defects in the delivered goods must be detected within one week of receipt and reported to ConFusion in writing, otherwise the assertion of the warranty is excluded.
  2. In this case, the burden of proof for the defect lies with the customer. If a defect is apparent in the delivered goods and is recognised by ConFusion after return, the customer can initially only demand the replacement of the goods. If the replacement delivery by ConFusion is not possible or involves a disproportionately high effort or if the replacement delivery is delayed beyond a reasonable period, the customer is entitled to withdraw from the contract, to demand a replacement delivery or a refund of the purchase price.

IX. DATA PROTECTION

  1. The customer declares his consent that his personal data contained in the purchase contract will be collected, stored and processed by ConFusion.
  2. The customer's personal data will not be passed on or made available to third parties. Exceptions to this are service partners who require the transmission of data for order processing. In these cases, however, the scope of the transmitted data is limited to the necessary minimum. The customer has a right to information as well as a right to correction, blocking and deletion of their stored data. For further details, please refer to our privacy policy.

X. FINAL PROVISIONS

  1. Should individual provisions of the following General Terms and Conditions become invalid, this shall not affect the validity of the remaining provisions.
  2. The place of fulfilment for delivery and payment is the registered office of ConFusion. Austrian law shall apply.
